The below terms and conditions apply specifically to web design and development clients of Hype Internet Marketing and Development. If you have any questions or concerns, feel free to contact us.

• All projects with Hype IMD require a deposit of 50% before any work can begin. The remaining balance must be paid upon completion of the project. Any other arrangements must be expressly documented and signed in print by both client and Hype IMD.
• Unless otherwise arranged, content for web site must be presented by Client. It should be understood that failure to present content within a reasonable amount of time during the project can delay a project indefinitely.
• Hype IMD only uses materials that are in accordance with copyright laws, and it is understood that all materials that the Client provides us do not violate said laws.
• Hype IMD shall not be held liable for the accuracy of any information supplied by the Client and contained in Client’s website.
• Hype IMD will be given final approval of a design by the Client before development begins on a website. Changes to the design after approval has been given and development has begun are not included in the initial agreement and are therefore billed at an hourly rate.
• Hype IMD and Client may agree to a schedule of deadlines before commencing work on a project. Meeting project deadlines will be dependent on the provision and procurement of content/information for the project by the Client. Failure by Client to provide content/information promptly will result in the project deadline being voided and the project being delayed.
• The cost estimates agreed upon by Hype IMD. and Client are based on the requirements specified in the accepted proposal. Any change in the requirements or delays in communication will have a direct impact on the cost of the project.
• Payments to Hype IMD for work already in progress that does not violate the agreement are non-refundable.
• In the event that any invoice is overdue for more than 10 days, Hype IMD reserves the right to stop work without any further communication.
• Hype IMD does not and will not give out Client’s confidential information, including but not limited to names, addresses and trade secrets. Hype IMD agrees to take reasonable precautions to prevent unauthorized disclosure of confidential information.
• Hype IMD reserves the right to change or modify any of the terms and conditions contained in this Agreement at any time and from time to time in its sole discretion, and to determine whether and when any such changes apply to both existing or future customers. Hype IMD may make changes or modifications to referenced policies and guidelines without notice to you. Your continued use of the Services following our posting of any changes or modifications will constitute your acceptance of such changes or modifications.
• Hype IMD reserves to display, discuss, or share elements of any Hype project in any portfolio or presentation given by a Hype IMD staff member.
• The initial quote/proposal we give you is based on the initial information you supply us. If the project is completed with no changes to the initial brief, then you are only liable to pay the initial quoted price. If, however, during the project, you, the client, request various changes to the design brief, Hype IMD will reserve the right to charge additional fees for this extra work. We will inform you of any estimated additional costs involved in any changes you request.
• All prices quoted in any proposal are valid for 28 days from the date of proposal. In some cases it is not possible to give an exact quote on certain services, and in these cases, an estimate will be given as a general guide to the expected price for that particular service.
• If there are any errors on your site that are due directly to a mistake on our part, we agree to fix these errors. Email us with a description of the error, and we will send confirmation of our receipt of your email and will begin to look into the matter. We aim to have all such errors fixed as soon as possible.

  It should be noted that we do not cover errors that originate as a result of any modifications made to your site by you or any third party, faults occuring due to your hosting provider, issues that arise due to unforeseen changes in Internet software, programming languages, or operating systems.

• Client is expected to grant Hype IMD access to all control panels and accounts related to development of project upon request. As Hype IMD is sensitive to the desire to keep password information private, Hype IMD strongly urges Client to change passwords before handing over any log in information, and change them immediately after. It is understood that Hype IMD takes precautions to protect sensitive information, therefore Hype IMD is not liable for lost or compromised accounts.
• Hype IMD is an independent contractor and not an employee of the Client, and, unless otherwise stated in this Agreement, is not entitled to any of the benefits normally provided to the employees of Client.
• The failure of either Hype IMD to enforce any provisions of this Agreement shall not be deemed a waiver or limitation of our right to subsequently enforce and compel strict compliance with every provision of this Agreement.
